Abstract:
The aim of this article is to provide an account of the state of human rights jurisprudence in the courts of Fiji, Vanuatu, Tonga, and Samoa and to explore the influence of human rights jurisprudence in those jurisdictions to date. The article will first give a brief context to human rights in the PICs1 to set the scene for an overview of the Fijian, Samoan, Tongan, and Vanuatu human rights jurisprudence in the last five years. The last part the article explores the influence of custom on the courts' jurisprudence and whether the ECtHR's margin of appreciation doctrine has taken some hold in the Pacific islands.
